The terms “we”, “us” and “our” refer to Dyamond & Co. The term “site” or “sites” refers to Dyamond & Co and all other connected sites, accounts and profiles. The terms “user”, “you” and “your” refer to the site’s visitors, readers, customers, clients and any other user of the site. We provide self-care products, subscription boxes, and more – hereby collectively referred to as “service” or “services”. By visiting our site and/or purchasing something from us, you are engaging in our “service” or “services".
Terms and Conditions
The use of dyamondandco.net, including all presented materials and all online services provided by Dyamond & Co are subject to the following Terms and Conditions. These Terms and Conditions apply to all site visitors, readers, customers, clients, and all other users of the site.
Use of Site and Services
You must be 18 years of age or older to access or use this site. Children under the age of 18 are not allowed to use the site.
Subscribing
By subscribing you agree to pay your subscription fee for the products that are delivered for the term agreed by both parties. Any introductory discount or free gift applied on the 6 or 12 month subscription means your first month is an introductory promo box. It also means you have a minimum of another 6 or 12 payments due on your commitment term before you can cancel. Generally, all of our introductory discounts and offers are only applied on the 6 or 12 month subscription. This will be made clear on our checkout process when you select your subscription length. If an offer is available on the 1 month subscription it will be stated there. If no offer is stated there, the offers do not apply to that subscription.
Subscription Renewal
All subscriptions automatically renew at the end of the commitment period unless cancelled by you, the customer. Your subscription will renew on the same date each month/6 month/12 month period, depending on your initial sign-up date. No refunds are issued if you fail to cancel before the renewal date. By signing up to a Dyamond & Co subscription you understand and agree you will be charged at the standard rate and that any promotional codes used as a new customer at signup do not transfer or apply to your renewal fee. You understand and agree that you will be automatically billed after your current subscription of 1, 6 or 12 months expires unless the subscription is 'set to cancel' before your final payment date in your initial commitment. By setting your subscription to cancel before your commitment ends this means your subscription will cancel AFTER your 6 or 12 month commitment ends and not beforehand. If you do not cancel your membership prior to your subscription renewal, your subscription will automatically renew for a new subscription period of the same amount of time.
Cancellation
At Dyamond & Co, we will be sad to see you go, but you can turn off your auto renewal at any time through your account profile in just two easy steps. However, when you sign up for a subscription, you are committing to the selected subscription period. We offer a 1-month, 6-month and 12-month subscription. The majority of our special offers are only offered with our multi-month subscriptions. We also offer different pricing based on the different subscription lengths.
Subscription Commitment
If you have purchased a longer subscription with remaining boxes, you will be charged and shipped the remaining boxes. Your subscription will then automatically cancel after the commitment period. Example: For a 12-month subscription, if you’ve paid for 8 boxes after your promo box, and decide to set your subscription to cancel at the end of your commitment period, you’ll be charged for and receive the remaining 4 boxes.
Cancellation Before Commitment End
If you choose to cancel your subscription before the end of your commitment period, you will be charged for the remaining boxes in that period. After the period ends your subscription will cancel and no more charges will be taken. No refunds will be issued for any portion of the commitment period.
Discount Revocation and Prorated Cancellation Charges
Any discounts applied to your initial subscription are contingent on completing the full commitment period. If you wish to stop all payments early, you may be required to pay the non-discounted rate for any boxes received, and/or a reimbursement for the free gift you received on the condition you would continue the 6 or 12-month subscription you decided to sign up for. (i.e. $30 fee)
Cancellation Process
You can cancel your subscription at any time by logging into your account and following the cancellation instructions. Cancellations MUST be completed at least 24 hours before your next renewal date to avoid being charged for the upcoming renewal period.
Refund Policy
Sorry, we do not offer refunds. Please note: this is a surprise box and there’s always a risk that you may dislike some of the contents on a particular month. If not happy with what’s inside, this is a perfect opportunity to re gift items to friends and family.
No Trial Periods
Dyamond & Co does not offer non-commitment free trial periods unless explicitly stated in a promotional offer.
Missing Boxes
You can replace or refund missing boxes within 30 days of the cut-off period (the 14th of each month).
Billing and Payments
You will automatically be charged each month for your ongoing subscription using the payment method used at the time of sign-up. You may change the payment method inside your customer login area at any time.
Prepaid Credit/Debit Cards
Prepaid credit/debit cards are not accepted.
Card Expiry
For your convenience and continuous subscription benefits as a member, if your payment method reaches its expiration date, you do not edit your credit card information and you have an ongoing subscription, you authorize us to continue billing that credit card on file including extending the expiration date until we are notified by you or the credit card company that the account is no longer valid. We encourage you to constantly update your payment method information or cancel your membership should you wish to discontinue your monthly purchase of products.
Processing and Shipping Times
All boxes are shipped on the 28th of each month. All orders will be shipped to the address provided at checkout and will arrive in 3-10 days. A tracking number will be provided once order has been shipped. We are not responsible for lost, stolen or delayed packages.
Tracking Information
Once your order has been shipped, you will receive a tracking number via the email address provided during the checkout process. This tracking number will allow you to monitor the progress of your shipment through the carrier's website.

Modifications to Services and Prices
Prices for our products and services are subject to change without notice. We reserve the right at any time to modify or discontinue a product or services without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of a product or service.
Refusal of Service and Right to Withdraw
All services are offered subject to our acceptance of your order or requests. We reserve the right to refuse service to any order, person, or entity, without the obligation to assign reason for doing so. We may at any time change or discontinue any aspect or feature of the site or service, subject to us fulfilling our previous responsibilities to you based on acceptance of your payment and start of work. Our discovery of new or incorrect information, changes, flagged orders or other factors tending to circumvent our policies and Terms and Conditions could result in our withdrawal. Noncooperation, changes of timeline or scope of work, disrespectful or ugly behavior, missed appointments or late payments are all examples of contributing factors. If we initiate the withdrawal process, all fees and deposits will be returned, except fair market value for all services and/or products already provided – at our current hourly rate, rounded to the next half hour.

The site and the service contain links to third party web pages and resources. You acknowledge and agree that we are not responsible or liable for the availability, accuracy, content or policies of third-party web pages or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such web pages or resources.
Products and Services
Certain products or services may be available exclusively online through the website. These products or services may have limited quantities. We have made every effort to display the colors and images of our products and services as accurately as possible. We cannot guarantee that your computer monitor's display of any color will be accurate.
Errors, Inaccuracies and Omissions
Occasionally there may be information on our site that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

We do not guarantee, represent, or warrant that your use of our services or products will be uninterrupted, timely, secure, or error-free. We do not warrant that the results that may be obtained from the use of the service will be accurate or reliable. You agree that from time to time we may remove the service for indefinite periods of time or cancel the service at any time, without notice to you. You expressly agree that your use of, or inability to use, the service is at your sole risk. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
This Agreement
The failure of us to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on this site constitutes the entire agreement and understanding between you and us and govern your use of our Services, superseding any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms and Conditions). Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

These Terms and Conditions and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of United States.
Amendments
We may at any time make amendments to these Terms and Conditions. Such amendments are effective immediately upon us posting the new Terms and Conditions on this site. Any use of the site or service by you means you accept and agree to be bound by these amendments. We reserve the right to update any portion of our site and service, including these Terms and Conditions at any time. We will post the most recent versions to the site and list the date at the bottom of our Terms and Conditions page.
